  1. IRS Announcement on Health Coverage Reporting on Tax Return

    Overview

    In response to President Trump’s recent executive order mandating that federal agencies reduce the burden of the Patient Protection and Affordable Care Act (PPACA), the IRS issued an announcement stating that tax returns will not be rejected if taxpayers didn’t note whether they had health insurance, made a shared-responsibility payment (under SEC. 500A) or were exempt.

    The IRS noted that in the past, it had not rejected returns that didn’t include the required information, but it had put systems in place this year that would have rejected tax returns that didn’t include the information.

    With the executive order, the IRS has suspended the rejection process. It is important to note that until legislation to repeal the requirement is enacted, the shared-responsibility payments still must be paid if taxpayers do not have health insurance or an exemption. Although returns will be processed without the information or payments, the IRS will issue follow-up notices after the returns have been processed.

    • Individual mandate penalties
    • Employer mandate penalties

    • Health Insurance, Rx, and medical device industry taxes

     
    What Supporters Say
    - There is no fix to Obamacare
    - These changes will achieve the following objectives:

    • Move healthcare decisions away from Washington to the states
    • Provide coverage protections and peace of mind
    • Make health insurance more affordable
    • Fix marketplace difficulties
    • Enhance competition

     
    What Critics Say
    - Changes may cause collapse of individual marketplace
    - Reduces support for low-income families
    - Proposed changes will restrict accessibility and will not lower cost

  3. ACA Under Trump: What Has Happened So Far...

    What Happened:
    - Republican plan to turn over Medicaid (Medi-Cal in California) to states released
    - Currently fed/state partnership for payment of healthcare expenses (for the poor)
    - Current funding is open-ended (meaning it shares costs for all costs for care to which people are entitled)
    - Replace with block healthcare grants to states
    - No details on how block grants would be structured (could be flat amount or per head amount)

    Supporters say: 
    - States then would then have defined pot of money to provide healthcare
    - Those closest to caring for the people can determine the best approach
    - Cut out the fraud, waste, and abuse
    - Get help directly to the people
    - No one will lose coverage

    Critics say:
    - Block grants would freeze the amount of money provided to states
    - Could lead to reductions in funding, and thus threaten benefits for millions

    What Happened:
    - Trump signed executive order (hours after in office)
    - One page order (no details)
    - Directs heads of HHS/other agency to not enforce regulations that impose a financial burden on a state, company, or individual

    Supporters Say: 
    - Trump is fulfilling campaign promise to repeal/fix Obamacare
    - Current regulations are choking business and government alike
    - No one will lose care because of this action

    Critics Say:
    - Replace plan hasn’t been vetted yet
    - Millions will be left without healthcare

  4. Compliance Reminder: Medicare Part D Creditability Online Disclosure to CMS

    Overview

    Federal law requires that employers provide annual notification of the Medicare Part D Prescription Benefit "creditability" to employees prior to October 15th.  However, that same law also requires plan sponsors to report creditability information directly to the Centers for Medicare and Medicaid Services (CMS) within 60 days of the first day of the ERISA plan year.  Many employers have a January 1 ERISA plan year (which may – or may not – coincide with your renewal or policy year); so for many employers, the deadline is in a couple of weeks!

    Mandatory Online Creditable Coverage Disclosure

    Virtually all employers are required to complete the online questionnaire at the CMS website, with the only exception being employers who have been approved for the Retiree Drug Subsidy (RDS). This disclosure requirement also applies to individual health insurance, government assistance programs, military coverage, and Medicare supplement plans. There is no alternative method to comply with this requirement! Please remember that you must provide this disclosure annually.

    The required Disclosure Notice is made through completion of the disclosure form on the CMS Creditable Coverage Disclosure web page. Click on the following link: CMS Disclosure Form.

    Employers must also update their questionnaire if there has been a change to the creditability status of their prescription drug plan, or if they terminate prescription drug benefits altogether.
